Looks to me like the guy set his reserve too low and was hoping more people would bid. So when only you bid he now pulls out of the deal. Is there no legal issue with pulling out of an auction??

Not sure Andries. I've NEVER had a problem like this before. Sucks it.
I was the only bidder and he told me the reserve on one of our email correspondences. His problem was, he listed the motor as a "V-8" instead of "V8" and I don't think anyone could find it.

seeing that this guy has bought 3 items in the past, 1 in the last 6 months I don't think he really cares if he gets banned or not. It would be nice to have the VIN and a copy of the salvage title to see who really owns this motor.

I don't what else I can say. Here is the whole deal. The auction closed and I saw that you had won. I went to the shop to start loading the engine into the shipping crate that I already had for it. (I share a race car shop with the guy I was selling it for). I got the crate out, but could not find the engine. I called him and that is when he said what I told you before, "Oh, I forgot to tell you, I sold the engine yesterday." Some one that had heard about it for sale locally through word of mouth came by the shop and paid him cash for it. I don't know who it was or what they were going to do with it. I can tell you this without any reservation, he did NOT back out because of buyers remorse. I know how much he had in the engine, and for the $1000 you bid, he was doing just fine.
This was the 2nd time I listed this engine on eBay. The first time I had several people emailing and asking questions just as you and others did this time. We got no bids until the last day and then we only got a bid of $510. When I confronted my buddy again yesterday afternoon, he said he checked the bid status and saw that on Saturday there were still no bids, so he was concerned that the engine would not sell AGAIN. So, when he got a cash offer in front of him (and I will tell you this, it was not a better offer, it was actually less than the reserve). He figured a bird in hand is worth 2 in the bush and took the money and did not call me so I could close the auction or post a comment that it had sold locally.
I know you don't know me from Adam's housecat, but I am telling you the truth. I try to do business honestly and ethically. Unfortunately, this happened, and I could not do anything about it. I don't know what the guy who bought it is going to do with it - put it in a vehicle or hold on and try to resell it for a profit - I just don't know.

that sucks, but it sounds like this guy may be honest and just got put in a bad situation by the owner of the engine.
if i were you, i'd start looking for another one, but i'd also keep an eye out for this one showing back up. i'd hold off on feedback for him for a month or so until you know for sure that it doesn't pop back up on ebay. if it doesn't, then give him a neutral, since it's not necessarily his fault that the other guy sold it and didn't tell him about it.
also, since he's in partners on a race shop, use this leverage against him to get him to pull some strings w/ his buddy's at a salvage yard for another one. he's got those connections if he's into racing...

This is why I don't sell stuff on eBay for friends. I don't want my feedback score hurt by someone else's mistake or lack of concern for the transaction. I had a neighbor just last night call me to sell some NCAA BB tickets for him on eBay and he could tell right off I didn't want to do it. The only way I would have done it was if he handed me the tickets and let me handle everything through delivery, but that's a lot of work and it's my feedback at risk.

if he still had the engine, then the may work, but if it is indeed gone into someone else's hands, then it would be better to just move on and not try to force either one of them to give it up. that would be your only legal recourse anyway...
