Check your laws on uncontrolled intersections, here in CA the person to the right, has the right of way, he should have yeilded.

 

This is crazy, I have nevered had a problem with insurance companies over a wrecked vehicle. They usually pay retail nada around me for a wreck. I would threaten to get new media in on your dispute and see if you can talk to someone in their home office like the ceo and complain!
