I feel your pain i got hit by a drunk driver, 4runner was ok no damge to my car. 1 month later i rearended a drunk driver the same way you did, 5000 dollars worht of damge but not totaled. 2 weeks ago, brakes went out rolled the runner and got stuck in a ditch but yet its still fine and runnin strong!!! so i feel your pain cause of the accidents but i still have my runner. Sorry to hear about yours!!!

Elton, I'm sorry to hear about your rig man. Especially considering it was so new to you, and such a clean ride. However, I'm more glad that you are okay.
My father was hit head on by a drunk driver trying to pass a snow plow in the middle of a snow storm. Spent some time in the hospital and nearly lost his life. I have absolutely no sympathy for drunk drivers. It should be an automatic, permanent loss of license in my opinion.
Keep your chin up. I'll keep my eyes peeled for a good deal since we are within a days drive.

I can't believe that could happen to someone. I had something like that happen to me when I purchased my 99 Tacoma. I was coming home from my 2 hour trip and and elderly man pulled out in front of me with his grandchild in the backseat. I managed to miss the Explorer, but nailed a highway sign that came threw my window. I was lucky the airbag didn't go off - that would have only caused more damage and probably hurt me.

Do NOT accept their first offer on the car.
it will be a lowball.
also find a lawyer for your neck and back injuries, about 3 months of twice weekly treatments, will make you feel better.
the lawyer will prolly not help you with the property damage.
And make his ins co rent you a 4WD SUV, not a Ford Escort or some crappy econobox.

i agree with roundhouse.we have to fight for what seemed like a year but in the end everything worked out. search on the internet and find 4runners in the price range of yours. and even higher ones if you can. print thoses out and take those to court with you. or give those to a lawyer or something. make sure a judge sees them. when my dad and i went through the same thing we did that and it helped. the girl who ran into my dad went to court and we were there. we watched it to make sure everything would go right. they will try to screw you over for a long time. DONT LET THEM. never give in. in the end you will get what you want.
btw while the girl was going to court for this she got another DUI. she probably wont be driving for a while.

Most important thing is no one was hurt, yeah the truck is a loss, but look at it this way, you bit a relatively mild bullet for someone else that could have died in the same situation, and got a drunk off of the road.

If I was you I'd ask the ins. co. how much for you to keep the truck if they total it. It doesn't cost anything to ask and you might be surpirsed how cheap you can buy it back for.
I got rea-ended on my motorcycle back in 95. They paid me off and I got the bike for $50.00.
